After a lengthy preliminary hearing (totaling about 20 hours and heard on four different dates starting on October 29th and concluding yesterday), Solano County Superior Court Judge Peter Foor has determined that enough evidence existed to try Benicia homicide suspects Kalasa Isumu (now 20) and Richard Lindsey (now 19) for the February 2008 murder of a 17 year old Vallejo youth on a Benicia street at the conclusion of an out of control party at the Benicia National Guard Armory.

A trial date has yet to be set. Both defendants remain in custody at the Solano County Jail in Fairfield. They face the following charges at trial:

Isumu: Murder, robbery (for the taking of a cell phone from a separate victim before the shooting) and assault with a deadly weapon (the assault charge is related to the murder charge). Isumu is being held on $2 million bail at the Solano County Jail in Fairfield.

Lindsey: Murder (as the person driving the getaway vehicle); threatening police officers, a felony (Section 69 of the California Penal Code); and brandishing an imitation firearm at police, a misdemeanor (417.4 of the penal code). Lindsey is being held on $1 million bail at the Solano County Jail in Fairfield.

Lindsey’s threatening and brandishing charges stem from his arrest on June 13, 2009. Lindsey came out of a relatives home to surrender to police then suddenly pulled out and brandished a replica firearm. Lindsey was shot and wounded by the surrounding officers.
