On Saturday, October 10, 2009, at approximately 2:25 a.m., Northeast Area Command patrol officers responded to an auto-pedestrian crash in the 6900 block of E. US 290 eastbound service road.

A preliminary investigation shows that a green Honda was traveling eastbound in the 6900 block of E. US 290 eastbound service road. Smith-Ayers was standing in the middle of the service road, wearing all black clothing, and was struck by the Honda.

Smith-Ayers was transported to University Medical Center-Brackenridge with life threatening injuries. On October 31, 2009, Smith-Ayers died as a result of the injuries sustained in this crash.

There is no evidence of alcohol or speed being a factor at this time. The driver of the Honda stayed at the scene and is cooperating with detectives. No charges are expected to be filed in this case.

This is the 54th fatality of 2009. During this time in 2008, APD had 52 fatalities for the year.
