On September 18th, 2008 the Vermont State Police was notified of an incident that had occurred on September 11th, 2008 involving a school teacher at the Richford Elementary School assaulting a 5th grade student. The parent of the student provided a photograph of the injury her daughter sustained from the incident and alleged that her daughter’s teacher, Ann Lavery, was responsible for the injury. The parent also notified the Department of Children and Families (DCF), who are also investigating the incident.
The allegation is that on September 11th, Ann Lavery, a teacher with 32 years of teaching experience, grabbed the student by the back of the neck causing pain and injury. This action by Lavery was due to the student not having permission to be in an area of the school where other students were present. Lavery is also said to have grabbed another student in a similar fashion for the same reason.
On September 12th, 2008, the same parent filed another complaint to the school detailing an incident that took place earlier that day. The same student was in a math class that was being taught by Lavery, with other students present in the classroom. Lavery had dumped a small plastic bucket that contained learning aides and placed the bucket on the student’s head and struck the bucket. This caused injury to the student and also damaged her glasses.
As a result of the investigation, Lavery has been cited to appear in Franklin County District Court on October 6th, 2008 to answer to two charges of simple assault.
The Vermont State Police notified the Richford Elementary School of the investigation and that Lavery was cited into court. At the time of this press release, the Richford Elementary School has not responded as to whether or not they plan to take action against Lavery.
